The use of this web site is goverened by the policies, terms, conditions listed below.  Please read them carefully.  Your use of this site indicates your acceptance of thses policies, terms, and conditions.  Your placement of an order online or by phone indicates your acceptance of these policies, terms, and conditions.  POG Photography and Images reserves the right to make changes to this site and these policies, terms and conditions at any time.  POG Photography and Images reserves the right to cancel free shipping promotional at any time.

TYPOGRAPHICAL ERRORS

While we make every effort to ensure the products information and pricing on our website to be accurate and current, there may be instances where inaccurate or incomplete data is displayed.  In the event item data is incorrect, such as listed with an incorrect price or with incorrect information, POG Online Enterprises, Inc. shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item.  In the event an item is mispriced, POG Online Enterprises, Inc., will do one of the following:

1. If an item is priced lower than the displayed price, you will be charged the lower amount and we will ship the item.
2. If an item is priced higher than the displayed item, we will either contact you for instructions or cancel your order and notify you of such cancellations.  If we cancel your order after your payment has been processed, we will issue you a full refund.

POG Online Enterprises, Inc. reserves the right to correct and/or update the content of our website at anytime without notice.

You agree that the sale and exclusive maximum liability to POG Online Enterprises, Inc. arising from any product sold on POG Photography and Images website, shall be the price of the product ordered.  Under no circumstances, including but not limited to negligence shall POG Online Enterprises, Inc. it's officers or other representatives be held liable for direct, indirect, special, incidental or consequential damages including but not limited to harm to products and/or personal injury or death arising out of the use, or the inability to use a product sold on this site.  POG Online Enterprises, Inc. does not make any representations regarding the liability, accuracy or reliability of or the results of the use of materials or products on any sites linked to this site.

ORDER ACCEPTANCE POLICY

An electronic, printed, or other form of order, does not signify our acceptance of an order and does not constitute confirmation of our order to sell.  Your printed reciept of an item or other form of printed order confirmation does signify our acceptance of your order and does constitute confirmation of our order to sell.  Your printed reciept must contain an order confirmation number that matches our order confirmation number.  POG Photography and Images reserves the right to limit the quantity on any and all products.  We may contact you regarding adjustments to your order, including but not limited to tax and shipping.  The charges at checkout may not be finial.  If any adjustments are made to your order you will be informed via an emial prior to us billing you.  Pricing is subject to change without notice. Please save your reciepts.

Shipping charges may change at any time.  If any changes occur without notice while your order is being processed, your order will be billed as of the posted prices before the change took place.  POG Photography and Images reserves the right to make any adjustments to shipping prices without notice.

POG Online Enterprises, Inc. has a 128mb SSL assuring that all information that you enter i sencrypted and can not be accessed by an outsider.  All transactions are 100% secure.  You can be fully assured that none of the provided information will be sold or impared for trade or sale.  Our customer's satisfaction is our top priority!  POG Photography and Images has an account with First Data Independant Sales whom are certified and goverened with Wells Fargo Bank, N.A. to handle all shopping cart transactions.

POG Photography and Images also has an seperate Merchant Credit Card Account with Electronic Merchant Systems and WAY Cell technology.  This system is used for the buyer who prefers to make an order via phone to avoid any online purchases.  Only the owner of POG Online Enterprises, Inc. (Barry) is allowed access to this credit card system.  Use of this system avoids any use of the internet credit card systems.  This system thus becomes more secure than the internet!  This system ultalizes the latest state of the art cell phone technology.  The WAY System accepts, Visa, MasterCard, Discovery Card, American Express, and Debit Cards.  Other Cards may be accepted.  Use of the WAY Cell System is based upon trust and integrity of the owner, Barry.  By using Barry and the WAY Cell System, you agree to not hold Barry liable to any negligence or criminal activity.  You also agree to an act of trust, that Barry will not be negligent nor involve himself in any criminal activity in the processing of /or use of your credit/debit card.  Should Barry suspect that a card is stolen and is attempted to be used for a purchase, Barry will initate an alert to Credit Card Theft Systems.  At any time Barry reserves the right to obtain more information from the owner due to suspecious credit card activity.  Should an error arrise, report it immediately to POG Images and Photography or the owner, Barry, via email or phone, to recieve prompt reconcilation.  Barry may also contact you should he suspect an error via email or phone.  Human errors can and do happen and in such situations errors will be corrected!  

To use this system:

1. The purchase must be calculated using the web site shopping cart as a normal purchase over the web. DO NOT click the finial submit button.  Instead: go to step #2
2. Hand write the purchase price of the item, shipping costs, taxes, and any coupons.  Have the finial price totalled and hand written. Then Exit the Web site.
3. Call Barry at 720-937-2547.  Have your card number ready, experation date, and total price.  (Barry will review the priced item, shipping cost, taxes and coupons to confirm the total price.)
4. Barry will then enter the total amount into his WAY Cell system with you on his cell phone.  In a few seconds Barry will notify you of your approved card or insufficent funds. 
5. If your card has insufficent funds you can try another card. 
6. Barry does not write down or is there any record kept of your credit card.  It is your responsibility to remember which card you used in this transaction should any issues arise.
7. Barry will send you two reciepts of your transaction via USPS mail with an email.  A hand written reciept with a confirmation Number and a print out from the WAY Cell system will be mailed.
8. Save these two reciepts should an issue arise - returning an item, damage during transite. or cancellation of order.  You will need the confirmation number on the hand written reciept.

ORDER PROCESSING / VERIFICATION PROCEDURES

All orders are processed upon reciept.  All items normally ship within 2-3 days from when the order was processed.  At any time POG Photography and Images reserves the right to delay shipping, due to the non availability of supplies.  You will be notified if a delay in shipping is to occur via email prior to shipping.

Overnight orders can not be shipped after 5:00 PM in order to arrive the following day.  In most instances, overnight orders must be made 24 hours before the planned arrival date.  POG Photography and Images reserves the right to decide if we can meet the 5:00 PM deadline.  Should a failure to meet the deadline occur, POG will phone and send an email to you and make alternate arrangements.  POG Photography and Images will refund any extra monies due to a failure.  Customers placing overnight and/or rush deliver orders should contact POG Photography and Images customer service at (877) 207-9023, in order to confirm that we are able to meet your time constraints.

Due to credit card verification processes we are required to ship to the address where you recieve your monthly credit/debit card statements.  If the address to which the order is being shipped differs from your billing address (the address to which your monthly statements are sent) please use the toll free number on the back of your credit card to contact your credit card company and create an "alternate shipping address," which is a simple note on your account authorizing purchases to be delivered to a destination other than your billing address.  Please arrange an "alternate shipping address" before placing an order with us.

If you recieve a notice that your order has been processed but is temporarily delayed, it will be shipped when it comes availabe unless you cancel the order.  Please contact customer service at (877)207-9023 to obtain a cancellation confirmation number.  Your order will remain open and active unless it is cancelled by you.

PAYMENT POLICY

POG Photography and Images accept Visa, Mastercard, Discovery Card, and Debit cards.  Orders placed with an international credit card or orders placed with a U.S. credit card being shipped out side the U.S. may not be accepted due to verification issues.  In the event that we can not verity your billing information we may require you to wire transfer payment prior to us shipping the product.  To pay by check, money order, wire transfer please contact customer service at (877) 207-9023.  Personal checks, money orders and bank checks may be held up to three weeks prior to shipping till the check or order is cleared.

SALES TAX / INTERNATIONAL ORDERS

POG Photography and Images shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the state of Colorado.  Each customer shall be solely responsible for all sales taxes or other taxes, for orders shipped to other states.  International orders may be subject to local import fees, customs, duty or additional taxes in the country of destination.  POG Photography and Images is not responsible for, or offer advice on import, fees, duty, customs, or taxes that you may have to pay when your merchandise arrives.  We recomend that you contact your customs import office for information about potential charges.  POG Photograhpy and Images is not responsible for any taxes, duty, custom fees, or shipping charges on any item being returned.

SHIPPING FEES AND POLICIES

Shipping fees are calculated based on multiple different criteria's such as weight, size, insurance, destination, different carrier prices, and shipping methods.  Shipping prices and methods for different carriers are only "extreme" estimates when using the shopping cart.  To calculate shipping fees please select your shipping method prior to checkout to determine shipping costs.  After your order is placed you will be notified in the check out phase prior to billing your credit card as to the exact amount of shipping fees before the finial submission.  If ordering more than one item and the multiple items are to be shipped to the same address select only 1 shipping method.  If ordering meltiple items to be shipped to multiple addresses then select multiple shipping methods.  With each item ordered and shipped to a different address, you must select the same amount of shipping methods for each product.  Orders shipped to Alaska, Hawaii, and Puerto Rico can not be shipped vie ground delivery.  Orders shipped to PO Boxes and APO's can not be shipped via FedEx or UPS.  If you do not select a shipping method, POG Photography and Images reserves the right to ship your order adjusted to the proper shipping method and lowest rate.  POG Photography and Images is not responsible for any delays or failures that may be caused by affiliated shipping carriers.  Take not that the selected shipping method is only guaranteed from the date of shipment.  POG Photography and Images will send a notice via email as to when the item is shipped including information such as confirmation numbers and anticipated arrival times.

FREE SHIPPING PROMOTION

The Free Shipping Promotion only applies to USPS delivery.  Only items that are shipped as "Flat" are sizes 2"x3" to 30"x40".  All items that are shipped as "Tube" have no size restrictions.  Free Shipping does not include insurance.  Insurance can be added to shipping, but must be requested by the customer and the fee must be additional, paid by the customer prior to shipping.  Please contact customer service at (877) 207-9023 if you are unsure about sizes of items.  POG Photography and Images reserves the right to cancel free shipping promotion at any time.

CANCEL AN ORDER

To cancel an order, please contact customer service (877) 207-9023 to obtain a valid Cancellation Number.  Orders can not be cancelled once they have been shipped.  All cancellation requests must be processed over the phone before shipment.  Cancellations will not be taken through email.  You must recieve a verbal response that you have cancelled your order.  An email will be sent to you to confirm your cancellation with a valid cancellation number.  Orders can not be cancelled once they are shipped or in transit.  In some instances our shipping department is en route to the selected carrier for shipping your package and can be intersepted just before giving the package to the carrier.

RETURN POLICY / PROCEDURE

POG Photography and Images, has a 21 day return on all items.  The return timeframe applies only to unopened packages.  All open packages is finial sale and can not be returned.  All returns must have a valid Return Authorization Number (RAN) which can be obtained by contacting customer service at (877) 207-9023.  A RAN must be issued within the 21 return time frame.  Returns recieve without a valid (RAN) will be shipped back to you.  Shipping fees are not refundable.  Once an item is recieved and processed your refund may require 5 - 7 business days before the credit is applied to your credit card.  For refunds other than credit cards please contact customer service at (877) 207-9023 to arrange your method of refund.  When the item arrives at POG Photography and Images, we will notify you via email.

To make a return:

1. Do not open the package
2. Contact customer service and obtain an RAN (return authorization number)
3. Write "Return to Sender" on the package.
4. Write the RAN on the package.
5. Use the same carrier that delivered the package.

DAMAGED PACKAGES

If you recieve a package that is punctured, folded/creased, or bent the item is damaged.  Return the package without opening it.  See the return policy/procedure.  If you open the damaged package POG Photography and Images can not accept the item as returned, that item is a finial sale.  When the package arrives at POG Photography and Images, we will notify you via email.  If you choose to have the damaged item replaced it will be sent in 2 to 3 days, after the item arrives at POG Photography and Images.  Your decision to have the damaged item replaced will be discussed when obtaining a RAN (return authorization number).  Should you change your decision to not replace the damaged item after obtaining an RAN, you must contact customer service at (877) 207-9023 before the replacement is shipped.  A refund will then be processed which is explained under the Return Policy

To Return a Damaged Package:

1. Do not open the package
2. Mark the damaged area with a felt tip marker using arrows (pointing to the damaged area) or circles (circling the damaged area).
3. Contact customer service at (877)207-9023 and obtain an RAN (return authorization number)
4. Write "Return to Sender" on the Package.
5. Write the RAN on the package.
6. Return the package to the carrier who delivered the package.

LOST / MISSING PACKAGES OR ITEMS

In the event that a package shows delivered and you have not recieved your package, contact customer service (877) 207-9023 to activate a tracer investigation which can take up to ten days.  If the investigation shows negative, POG Photography and Images will notify you via email with further instructions and information.  If the package arrives damaged and/or the item is missing, please keep the package and call customer service for futher instructions.  Each carrier (USPS, FedEx, UPS) has different guide lines and policies for such occurances and vary in the amount of time they require to handle such cases.  Missing items must be reported within 2 business days.

COUPONS

Use obtained coupon numbers for discounts.  POG Photography and Images reserves the right to at anytime cancel a coupon number if the coupon has a time limit.  A coupon number must be varified in order to recieve the discount.  Once varified a confirmation will be sent via email. 

Coupons Can Be Obtained From:

1. Purchase of an item from POG Photography and Images during a promotion.
2. Purchase a POG Photography and Images via a link from another website.
3. Visiting an Art Festival where POG Photography and Images has a display booth.
4. From viewing POG Photography and Images blog (barryspictures.com) at various times in the year.
5. From recieving a yearly post card via US mail (you must be on POG Photography and Images mailing list).
6. From recieving an occasionial email (you must be on POG Photography and Images email list).

WEBSITE LINKS POLICY

Should POG Photography and Images, suspect any criminal activity or learns of any criminal activity from any links that POG Photography and Images is linked to, a notice will be posted on POG Photography and Images Blog (barryspictures.com) and an email will be issued to all past and present customers who are on the email list.  A notice will be posted on POG Photography and Images website.  Your personal safety is a major concern of the owner, Barry, just as his own personal safety is a concern.

POG Photography and Images takes a strong stand against any form of internet nudity, indecent images or violence.  Any links that POG Photography and Images learns about which is linked to a site that involves nudity, indecent images or violence will be cancelled.  Please inform POG Photography and Images should you see a link suggesting, viewing, or suspecting any form of nudity, indecent images or violence.  POG Photography and Images can not monitor all our links with other websites on a constant basis.  We rely upon your help.  POG Photography and Images' premises are based upon morality and integrity, two words we at POG Photography and Images believe the present generation has lost the meaning of!
